Terms and Conditions

Whilst we try and ensure that all details, descriptions and prices which appear on this website are accurate, we reserve the right to correct any errors.

Items on this website might sell out and become unavailable or out of stock. Product measurements might be modified or vary slightly.

Reproduction of colours is as accurate as possible, but please note colours in-store may vary slightly from what is displayed on your monitor.

Some items which appear on this website are for illustrative purposes only and will not be available for purchase.

We may change or add to this website (including these Terms and Conditions) or the information, products and services without notice. 

CUSTOMER ORDERS

Orders are placed by adding products to your cart and completing the steps to finalise your order on the Elements Outdoor Living website. Phone orders can also be placed and the customer will receive an email confirming your purchase with an order/receipt number.  By confirming your order with the products selected, you confirm that you agree to the Elements Outdoor Living Terms and Conditions.

If Elements Outdoor Living cancels the customer order, the purchaser has the right to a full refund. When the purchaser cancels the customer order, the purchaser is entitled to a store credit voucher equal to the amount paid so far, less any cancellation charge. The cancellation charge is the full amount of the purchase price if goods ordered are less than $10 in value, or 20% of the total price if greater than $10.

On goods arriving in store, the purchaser will be notified and will have 30 days to collect goods. Should the purchaser fail to collect the goods the retailer will contact the purchaser and advise that the goods will be cancelled after 7 days unless full payment is made within that time, unless prior arrangement has been made with the store.

Delivery dates given are only an estimate.  Elements Outdoor Living charges a flat rate for specific areas and will be included on checkout.   A delivery charge is for one delivery only. 

Elements Outdoor Living reserves the right to decline a sale due to unforeseen circumstances such as unavailability of the purchased product. In this case, Elements Outdoor Living will promptly provide you with alternative product options available, a backorder (if this is available) a store credit or full refund of the purchase price.

Partial pick-ups are available if goods taken are fully paid for, and goods remaining still have a full 20% deposit paid.

It is the responsibility of the purchaser to notify the retailer of any change of address, email address and phone details.

WARRANTIES

Our goods come with warranty terms which cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Manufacturer’s guarantees against structural faults are outlined on the manufacturer’s documentation supplied with our goods.

 REFUNDS AND RETURNS

 A customer may be entitled to a refund, exchange or credit if the products:

    • Are damaged or faulty
    • Do not do the job that they were led to believe they would
    • Are not as they were describe
Elements Outdoor Living does not have to accept the return of a product if you:
    • Have no proof of purchase (e.g. do not have a receipt)
    • Change your mind about the product
    • Damages have been made to the product
    • Knew or should have known about a fault when purchasing the product (factory seconds, floor stock)

Products must be returned at customers cost within 7 days.

Elements Outdoor Living takes no responsibility for any products returned by you that are damaged during transit. It is your responsibility to ensure that products are returned safely and undamaged.

LAY-BY

Lay-bys must be completed within 3 months.

Payments are due on a fortnightly basis.

If the retailer cancels the lay-by the purchaser has the right to a full refund. When the purchaser cancels the lay-by, the purchaser is entitled to a store credit voucher equal to the amount paid so far, less any cancellation charge. The cancellation charge is the full amount of the purchase price if goods ordered are less than $10 in value, or 20% if the price is greater than $10 .

There is no cancellation fee if the retailer cannot supply the goods.

Should the purchaser fail to honour the lay-by terms and conditions (e.g. no fortnightly deposits), the retailer shall contact the purchaser and advise that the lay-by will be cancelled after 7 days of notice unless a payment has been received within that time.

Should the purchaser not pay outstanding monies due, the lay-by goods will be cancelled, goods returned to stock, and any monies due, minus cancellation charge, refunded to the purchaser.

It is the responsibility of the purchaser to advise the retailer of any change of address, email address or phone number.
